Thanks for visiting motozaperformance.com! These terms and conditions apply to all transactions and orders with Motoza Performance via website, invoice, or phone. They represent a contract between you the purchaser, Harlot Motorsports, LLC, dba Motoza Performance, a Colorado LLC. Terms and conditions are subject to change without notice. Please review them with each purchase.
Waiver Signature May Be Required
Products on this site are off-road use only and may require a digitally signed form prior to shipping stating that you understand and further agree to these terms. Currently all California customers must sign this form.
Federal Law States:
Vehicle Code § 27156:
(b) No person shall operate or leave standing upon a highway a motor vehicle that is required to be equipped with a motor vehicle pollution control device under Part 5 (commencing with Section 43000) of Division 26 of the Health and Safety Code or any other certified motor vehicle pollution control device required by any other state law or any rule or regulation adopted pursuant to that law, or required to be equipped with a motor vehicle pollution control device pursuant to the National Emission Standards Act (42 U.S.C. Secs. 7521 to 7550, inclusive) and the standards and regulations adopted pursuant to that federal act, unless the motor vehicle is equipped with the required motor vehicle pollution control device that is correctly installed and in operating condition. No person shall disconnect, modify, or alter any such required device.
(c) No person shall install, sell, offer for sale, or advertise any device, apparatus, or mechanism intended for use with, or as a part of, a required motor vehicle pollution control device or system that alters or modifies the original design or performance of the motor vehicle pollution control device or system.
Health and Safety Code § 43000:
43001. The provisions of this part shall not apply to:
(a) Racing vehicles.
As the aforementioned code sections outline, it is against the law to operate or use a vehicle on public streets or highways with modified, altered, or disconnected motor vehicle pollution control devices. This may include but is not limited to, Evaporative Fuel Controls, Catalysts, DPF, PTOX, PCV Systems, Exhaust Gas Recirculation Systems, Oxygen Sensors, Thermostatic Air Cleaners, Air Intake Systems, Fuel Injectors, Regulators, Adjustable Cam Gears, ECU Programming, Mapping, or other Computer Modifications. Air Pumps, Air Injection, Timing, and any other Emission System Modification(s).
The purchaser acknowledges on check-out and prior to shipping, that Motoza Performance products may not be used on public roads and are sold for racing applications. The purchaser certifies that their intended use is for racing and/or off-road applications and that Motoza Performance products will not be misused.
Purchaser agrees to indemnify Motoza Performance, its parent companies, all employees, officers, owners, and subsidiaries for any civil or criminal liability arising out of use of Purchasers vehicle on public streets or highways as Purchaser has been duly notified of the laws and regulations regarding disconnecting, alteration, or modification of a vehicle’s pollution control devices. Purchaser understands and acknowledges that they have been advised that driving a modified vehicle on public streets or highways could result in criminal or civil penalties.
We recommend driver training prior to the use of performance upgrades on a closed course.
Return Policy
Software
Returns are accepted on all unused, unopened tuning kits prior to initial setup within 30 days of purchase. Buyer is responsible for return shipping. An RMA is required for return. Please contact us if an item needs to be returned, we will issue an RMA for return or exchange based on the situation. A refund less the original shipping amount and transaction fees will be issued upon receipt of the product in good condition. PayPal no longer refunds merchants for transaction fees; should they change this policy we will update ours. Unused items not in original packaging are subject to an additional 15% restocking fee. Items not in resalable condition will not be refunded.
Returns on tunes after initial setup may be accepted on a case by case basis. All returns on developed tunes are subject to verification that the ECU has been returned to stock; in most cases this will require that the ECU is shipped to us; there is a $50.00 labor fee to return the ECU to stock plus the cost of shipping.
Returns on developed tunes are subject to a labor charge of $75.00 per hour based on the number of revisions and complexity of the initial setup. Please email support if you need to make a return.
Parts
Professional installation is recommended for any aftermarket parts.
Unused, uninstalled parts in original packaging may be returned within 30 days of purchase for a refund minus shipping and transaction fees; buyer is responsible for shipping. After 30 days, and within 90 days of purchase, parts may be returned for store credit.
Unboxed, uninstalled parts may be returned but are subject to a 15% or higher restocking fee depending on condition. Used parts are not returnable unless due to a warranty claim.
Return Shipping
We suggest the use of a shipping method with tracking and insurance. We recommend using a shipping box and packing materials that are the same or similar to ensure safe transit of your items. We will not refund items lost or damaged in shipping; if insured, the shipper will cover your costs. We are happy to help you file a claim with your shipper if you have proper documentation. If your return is due to an error on our part, (e.g. we shipped the incorrect part), we will issue a shipping label for your return.
Used parts may be returned for warranty either to the manufacturer or to Motoza Performance; please contact support to start a warranty claim and see the warranty section below. Return Materials Authorization will need to be included.
Refunds are issued within 10 days of return and refund deposit time is determined by the policies of the payment method used. Returns without a Return Materials Authorization may take longer to process.
Shipping Address
Our payment processors require shipment to the address entered at checkout. It is the purchaser’s responsibility to verify the information entered. If you realize you have supplied an incorrect address after placing an order, please contact us immediately. Your order may need to be cancelled and placed again and we will assist you with that process. The signature requirement on certain items is for your protection and ours. The purchaser is responsible for arranging re-delivery or pick up if they are unavailable when the package is delivered. Shipped items cannot be re-routed by Motoza Performance. We do not ship to PO boxes.
Refused or Undeliverable Orders
Refused orders or orders marked undeliverable will be subject to return shipping fees and custom clearance charges. Your order will be refunded less the original shipping charges, return shipping charges, and transaction fees.
Damaged Items
All merchandise is in good condition when it leaves our shipping department. All orders are shipped FOB. If a part is lost or damaged via transit, you should immediately notify Motoza Performance and the carrier; take photos immediately. DO NOT DISCARD BOXES, PACKING MATERIAL, OR DAMAGED PARTS. Carriers may deny claims without original packaging. Carriers may also require that a representative visit the delivery address to inspect merchandise and packaging. Retain all packing materials and parts until the claim is paid. Carriers claim processes vary in duration and may take several weeks. We are unable to issue replacements until claims are paid. ALL merchandise is shipped and insured for full value and the responsibility for proper delivery is upon the carrier. Parts over $200 and tuning kits with injectors require a signature on delivery.
International Orders
All prices and payments are in USD. Pricing and the day’s exchange rate are determined by your payment method and may include additional fees and surcharges. All duties and tax are the responsibility of the purchaser. We suggest contacting support to place international orders. Doing so will allow us to help you select the shipping method best suited to your order. You will still be able to complete payment securely online. Please note that we cannot misrepresent the cost of your items to avoid duty and tax. Orders placed directly on the website will ship via USPS unless otherwise noted. Once a USPS shipment is transferred to your country’s postal service, we are not able to access the shipment or provide information. Please contact your local service with inquiries. We cannot ship to China, Russia, or any country under US Government sanctions.
Warranty
Motoza Performance warranties all Motoza hardware against manufacturer defect for 1 year from date of purchase. Warranty is non-transferrable. Parts and hardware not manufactured by Motoza Performance are subject to the warranty policy of the manufacturer. We will gladly assist you with warranty claims for parts from other manufacturers, or you may contact them directly.
Disputes
We agree to provide all reasonable methods to resolve disputes or discrepancies. Purchaser agrees to contact us within 48 hours of any dispute. The customer agrees that as the cardholder or authorized account user, you will not initiate any chargeback or claim procedure with our merchant bank or your creditor without first contacting us and receiving verification that you have provided us with the opportunity to resolve the claim or dispute.
Transfer of Tunes
Tunes are sold to one individual and one vehicle. We do not support tunes on ECUs removed from the car that was originally tuned without prior authorization and reserve the right to refuse this service under any circumstance.
Purchasers of previously tuned vehicles will need the full name of the original tune owner and proof of purchase in order to transfer tune support. An ownership transfer fee will apply. We suggest providing the new owner with your sales receipt. If you no longer have your receipt, please reach out to support prior to selling your vehicle and in most cases, we can provide you with documentation to give to the new owner.
The ownership transfer fee entitles the new owner to member’s site access, the ability to purchase tuning upgrades, and a single log review. Additional log reviews and upgrades may be purchased by the new owner of the vehicle with proper documentation. If selling an undeveloped tune/kit, you must provide the buyer with proof of purchase. We recommend contacting us via email if you plan to do so. We reserve the right to deny any owner transfer.
Unauthorized use of the member portal will result in account suspension.
Six Month Tuning Window, Log Reviews, Hardware Changes and Power Gains:
Each tune is sold with a number of log reviews following the issuance of the original tune file. Hardware changes from the original specified configuration may incur a fee. After the six month tuning window has expired, additional log reviews or reworks may be purchased. If you have questions about the tuning window, please contact support. Extensions may be made on a case by case basis.
A log review may or may not result in a file revision being issued. In the event that your log data indicates a mechanical issue, we will inform you and you will be responsible for repairs. Each log is reviewed by a member of our tuning staff and this review counts toward your total. We suggest making all efforts to repair noted issues so as not to waste reviews. Beginning the process with a car in good working order will ensure the most efficient use of time and reviews.
Not all mechanical issues will be apparent in logs. While every effort is made to help you identify and solve any issues, this is a remote process, and as such, vehicle issue may require diagnosis by a qualified mechanic. We advise you to scan your vehicle regularly for codes and to have regular maintenance performed. Performance vehicles require a more rigorous maintenance schedule. Mechanical issues may prevent your vehicle from performing as expected. Existing mechanical issues and flaws will typically be exacerbated by tuning, therefore, proper preparation is strongly recommended. We can work directly with your mechanic in many cases.
Power gain information is supplied based on our testing and represents an average result. Your results may vary due to vehicle condition, vehicle parts, environmental conditions, or differences in measuring equipment such as dynamometers.
Order Acceptance:
Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is canceled after your credit card has been charged and prior to shipping, we will issue a credit to your credit card in the amount of the charge.
If a shipped order is cancelled due to a violation of the off-road and track use only section of our terms and conditions items are required to be shipped back at the buyers expense. This may include the shipment of your ECU to have it returned to stock. Your order will be refunded less shipping, transaction fees, and a $50 labor charge to revert your ECU to stock if applicable.
Order Cancellation
If an order is cancelled prior to shipping, a full refund will be issued. If cancelled after shipment, purchaser is responsible for shipping and transaction fees.
Retroactive Sale Pricing
Sale pricing is not retroactive. Should you wish to return and repurchase at the sale price, the return will be subject to shipping and transaction fees.

Due to the level of service we provide, we may not be immediately available by phone. Please request a call via email or leave a voice mail so that we can return your call.
